BTS CONCERT TICKET RAFFLE
The organiser of the BTS Concert Ticket Raffle (the “Raffle”) is: MCM Global AG, with a business address at Baarerstrasse 137, 6300 Zug (“MCM”). By participating in the BTS Concert Ticket Raffle, entrants agree to abide by the following terms and conditions.
1. Raffle
This Raffle is open to eligible residents of Germany, Austria, and Switzerland via the dedicated MCM Sign-Up page created for the Raffle by MCM (the “Platform - Jotform”) or via the official MCM advertising campaign on Meta (Facebook/Instagram).
2. Participation in the Contest
a. The Raffle will run via the Platform and the Meta advertising campaign from 15 June 2026 to 30 June 2026 (the “Promotion Period”). Participation in the Raffle must take place within this period. Entries received before or after the Promotion Period will not be considered.
b. Participation is restricted to residents of Germany, Austria, and Switzerland who are at least 18 years of age (or the age of majority in their country/state of residence, whichever is higher). Employees of MCM or a company affiliated with MCM (e.g. in accordance with §§ 15 ff. German Stock Corporation Act), and their immediate family members, are excluded from participation. Eligibility requirements and any additional conditions may vary by region in accordance with applicable local law.
c. To participate in the Raffle, entrants (“entrants”) must sign up directly on the dedicated BTS Concert Ticket Raffle Sign-Up page Jotform. One entry per person. Entries generated by automated means, or which are incomplete or illegible, are void.
d. MCM reserves the right to disqualify any entrant that does not comply with these terms and conditions or is deemed inappropriate.
e. This Raffle is in no way sponsored, endorsed, administered by, or associated with BTS, the concert organizer, the venue, the ticketing platform, Meta (Facebook/Instagram) or any other social media platform. By participating in this Raffle, entrants hereby release Meta and any such platform, as well as MCM, from any and all claims and liabilities associated with the Raffle, to the extent permitted by applicable law.
3. Processing of the Raffle
a. Following the close of the Promotion Period, all valid entries will be entered into a prize draw. Two (2) winners will be selected at random across the three markets (Austria, Germany, and Switzerland), for a total of two (2) winners.
b. Each winner shall receive two (2) concert tickets to the BTS Concert in Munich on the 11th July 2026 as their prize as well as one (1) gift voucher for the MCM Munich Store Maximilianstrasse in the value of 1.000 EUR to use during a styling session on the 11th of July 2026 in the MCM Munich Store. After the Promotion Period ends, the winner will be selected and contacted directly to communicate the win and to arrange the prize delivery process. The German Team is responsible for delivering the prize to the winner in its region. If a winner cannot be contacted within a reasonable period of one (1) week, or does not respond within the timeframe specified by the relevant market, MCM reserves the right to select an alternative winner.
c. Prizes are non-transferable and cannot be exchanged for cash or other products. MCM reserves the right to modify or cancel the Raffle at any time without prior notice. MCM will make use of this option in particular in the event of technical or legal issues that may cause that the proper running of the Raffle cannot be guaranteed.
d. This Raffle is subject to all applicable laws and regulations in each participating country. Where local legal requirements differ, the conditions applicable to entrants in a given country shall be governed by the laws of that country. MCM reserves the right to adapt these terms as required to comply with local law in Austria, Germany, and Switzerland.
4. Data Protection
a. MCM observes all relevant data protection regulations in the context of the Raffle, including the EU/German GDPR for entrants in Germany. The data protection provisions in Sections 4.b–4.d below describe the GDPR basis applicable to EU entrants; equivalent protections apply to entrants in other regions under their respective local laws.
b. Participation in the Raffle is voluntary. The respective entrant him/herself provides information of surname and first name, mobile phone, birthday, city, and email address in the shared content via the sign-up process in the Platform.
c. By participating in the Raffle, a contract is concluded between MCM (the organiser) and the entrants. Participation in the Raffle is free of charge, in the sense that participation in the Raffle is not dependent on a participation fee. However, participation in the Raffle is only made possible by consenting to the promotional use of the entrants’ data by MCM. Participation in the Raffle is therefore linked to consent to receive advertising by newsletter and telephone. Entrants’ consent to the promotional use of their data (newsletter mailing, telephone calls) constitutes the service in return for participation in the Raffle. The legal basis for the processing of the personal data provided by the entrants in this context is Art. 6 para. 1 lit. b GDPR, namely the fulfilment of the contract.
After subscribing to the newsletter, entrants have the option to unsubscribe from the newsletter by clicking on the “unsubscribe link” in the footer of the newsletter. Entrants can also object to advertising calls verbally or in writing at any time. Participation in the Raffle is linked exclusively to consent to the promotional use of the entrants’ data and not to cancellation of the newsletter or other advertising measures. Entrants are therefore not excluded from the Raffle if they subsequently object to advertising measures.
We may include visible and invisible image files in our newsletters and other marketing emails. If such image files are retrieved from our servers, we can determine whether and when you have opened the email, so that we can measure and better understand how you use our offers and customize them.
d. Within the scope of the promotional use of entrants’ personal data, entrants may be informed about news, events and offers from MCM and its affiliated companies. For this purpose, the above-mentioned data will be transmitted to MCM Global AG, Baarerstrasse 137, 6300 Zug, Switzerland and the rest of the MCM Group.
e. In order to comply with retention periods under tax and commercial law, MCM stores the personal data collected as part of the Raffle for a period of up to 10 years. The entrant can request information about his/her personal data at any time and have it corrected and/or deleted and/or restrict the further processing of this data.
f. To exercise the aforementioned rights, the entrant can contact MCM by letter to the contact details above. If the entrant has any questions, comments or requests regarding the collection, processing and use of personal data by MCM, the entrant can contact MCM at any time using the contact information provided. If the entrant is of the opinion that the processing of data violates data protection laws, the entrant is entitled to lodge a complaint with a supervisory authority.
g. Further information on the processing of personal data and the rights of entrants can be found in the privacy policy. In this context, MCM is considered the controller within the meaning of Art. 4 No. 7 GDPR.
5. Liability
a. MCM shall be released from all obligations arising from this Raffle after the prize has been sent to the entrant, except for any obligations or liabilities that cannot be excluded under applicable mandatory law.
b. MCM shall only be liable for damages caused by gross negligence or intent on the part of MCM, a legal representative or vicarious agent of MCM.
c. In addition, in the event of a slightly negligent breach of material contractual obligations, MCM shall be liable for foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies on and may rely.
Otherwise, the liability of MCM is excluded.
d. MCM’s liability resulting from injury to life, limb or health remains unaffected by the afore-mentioned limitations of liability. MCM’s liability under the applicable mandatory product liability laws and for a guarantee assumed by MCM shall also remain unaffected.
e. Furthermore, MCM shall not be liable if the contest cannot be held and/or the participant cannot claim the prize due to force majeure or other obstacles that MCM could not foresee and/or influence and that cannot be overcome by reasonable efforts, provided that MCM is not responsible for them.
6. Acceptance of Terms
a. By participating in the Raffle, entrants acknowledge that they have read, understood, and agreed to abide by these terms and conditions.
b. Entrants further agree to comply with any additional instructions or rules provided by MCM during the course of the Raffle.
7. Miscellaneous
a. Legal action is excluded. This does not apply with regard to data protection issues.
b. Should one of these provisions be or become invalid, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation.
